Elfogadhatatlannak tartja az alaptörvény negyedik módosítását a Velencei Bizottság jelentéstervezete, mely szerint a jogalkotó állandósította a magyar alkotmányos rendszer hibáit. A már elkészült, ám csak június közepén elfogadásra kerülő dokumentum csütörtökön véletlenül került ki a Velencei Bizottság honlapjára.

A Velencei Bizottság (VB) jelentéstervezete a negyedik magyar alaptörvény-módosításról vélhetően egy műszaki hiba folytán vált néhány órára elérhetővé tegnap a testület honlapján, ugyanis a szervezet csak a június 14-15-i közgyűlésén tárgyalja és fogadja majd el a dokumentumot – írja a Népszava, amelynek azonban sikerült letöltenie a szöveget.

Az osztrák Christoph Grabenwarter, a német Wolfgang Hoffmann-Riem, a lengyel Hanna Suchocka, a finn Kaarlo Tuori és a belga Jan Velaers által készített, 34 oldalas, 7 fejezetes jelentés összesen 155 pontban fogalmazza meg kritikáit az alaptörvény legutóbbi módosításával, valamint a kialakult alkotmányos helyzettel kapcsolatban. A jelentés 7 fejezetéből 6 tételesen elemzi a negyedik alaptörvény-módosítás passzusait, különösen nagy figyelmet szentelve az Alkotmánybíróság (Ab) “döntéseinek felülírását” jelentő rendelkezéseknek, a korábbi határozatok hatályon kívül helyezésének, valamint az alkotmánymódosítások felülvizsgálatát korlátozó passzusnak. A jelentéstervezetben külön fejezetet kapott “az alkotmány folyamatos használata” is, ami a VB kritikái alapján is azt jelenti, hogy a sarkalatos törvényhozás, valamint az alaptörvény maga az utóbbi három évben a kormányzó kétharmad céljainak rendelődött alá, döntéseik bebetonozását szolgálta.

“A bizottság soha nem tagadta a parlament szuverén jogát ahhoz, hogy elfogadja vagy módosítsa az alkotmányt, de bírálja a magyarországi eljárást és módszereket” – írták. Úgy vélték, egy ország alkotmányának “valóban egy alapvető dokumentumnak” kell lennie, “és nem egy esetleges politikai nyilatkozatnak”. Kiemelték, az alkotmányok elfogadásának és végrehajtásának módja hűen kell tükrözze ezt a stabilitást, “nem lehet naponta, szeszélyeknek engedve módosítgatni” az alaptörvényt. Ráadásul a legutóbbi módosítás egyes rendelkezései együttesen és külön-külön is “ellentmondanak a magyar alaptörvénynek és a nemzetközi normáknak”.

A VB különösen fájlalta, hogy az Ab korlátozása “negatív hatással van az Európa Tanács (ET) alapelveit jelentő mindhárom pillérre: a hatalmi ágak szétválasztására, mint a demokrácia alapvető tételére, az emberi jogok védelmére és a jogállamiságra”. Hangsúlyozták: a magyar alaptörvény nem lehet politikai eszköz, jelenlegi szolgálatba állítása “veszélyezteti a jogállamiságot és a demokráciát”.

Harangozó Gábor, az MSZP országgyűlési képviselője a tervezettel kapcsolatban azt mondta, ez szerinte minden korábbinál sokkal keményebb megállapításokat tesz, és tisztába teszi, hogy ez korántsem politikai vita, jogi alapon vannak súlyos gondok a magyar alaptörvénnyel. A jelentéstervezet szerinte azért is eltér a korábbiaktól, mert a kormány érveit tételesen ismerteti és cáfolja is.

A VB kimondta emellett azt is: az, hogy egy rendelkezés más országokban is megtalálható, az ottani sajátos jogrendszerbe beillesztve, “nem igazolja a demokratikus hitelét az ember saját hazájában”. A jelentés számos további ponton is cáfolja a kormány érvelését, így például a 88. pont egyértelműen kimondja, nem igaz, hogy az Ab kötelezte volna a jogalkotót arra, hogy módosítsa az alaptörvényt az átmeneti rendelkezések miatt. Megállapították azt is, nem bővítette a negyedik módosítás az Ab jogköreit, hanem éppen hogy tovább korlátozta.

Noha az állásfoglalásnak nincs direkt joghatása, már több európai szervezet jelezte: ezt veszik alapul saját vizsgálataik során, melyekről a következő hetekben az EU és az ET is dönt.
