A magyar hatóságok megsértették az információhoz való alapvető jogot

A magyar hatóságok azzal, hogy megtagadták a védői munkára kirendelt ügyvédek adatainak kiadását a Helsinki bizottság számára, megsértették az információhoz való hozzáférés alapvető jogát – így határozott az Emberi Jogok Európai Bírósága kedden kihirdetett ítéletében.

A strasbourgi székhelyű bíróság az információszabadság európai szintű védelmében hozott döntése indoklásában kiemelte, a civil szervezet közérdekű adatokat kért a magyar hatóságoktól, amelynek megtagadása az információ szabad hozzáférését és közreadását rögzítő jogszabály megsértését jelentette.

A Magyar Helsinki Bizottság (MHB) 2009-ben a védők kirendelésének gyakorlatát elemezve adatokat kért helyi és megyei rendőrkapitányságoktól arról, hogy név szerint kiket és hány esetben rendelt ki a nyomozó hatóság védőként 2007-ben és 2008-ban. 28 kapitányság, köztük a Hajdú-Bihar megyei és a debreceni ennek nem tett eleget, ezért őket beperelték.

Az indoklás szerint a Helsinki bizottság az adatokkal azt szerette volna bizonyítani: elterjedt gyakorlat, hogy a rendőrség ugyanazon ügyvédeket választja ki a rászorult terheltek védőiként. Ez olyan összefonódáshoz vezethet egyes rendőri szervek és ügyvédek között, amely veszélyezteti a terheltek hatékony védelemhez való jogának érvényesülését.

A bíróság álláspontja szerint a kirendelt védők tevékenységével kapcsolatos adatok megismerhetetlensége ellentétes Az emberi jogok európai egyezményének 10. cikkében foglalt, a szabad véleményalkotáshoz és a közérdekű adatokhoz való hozzáféréshez fűződő joggal. A döntés egyezményellenesen korlátozza a civil szervezet alapvető jogát – húzták alá.

A bíróság úgy ítélte meg, hogy a kormány érvei nem voltak elegendők annak bizonyítására, hogy a panaszolt intézkedés szükséges volt-e, valamint megállapította, hogy a hivatalból kirendelt védők adatainak kiadásának megtagadása nem volt arányban az elérni kívánt céllal, a személyes jogok védelmével.

A Magyar Helsinki Bizottság 2011 áprilisában fordult az Emberi Jogok Európai Bíróságához, mert a budapesti Legfelsőbb Bíróság 2010. szeptemberi döntése szerint a rendőrség által kirendelt védők neve és az általuk egy adott évben vitt ügyek száma nem közérdekből nyilvános adatnak minősül. Azok nem ismerhetők meg, a kirendelt védők személyes adatainak kiadására a rendőrség nem köteles.

Korábban, a Debreceni Városi Bíróság 2009. októberi ítélete közérdekűnek és nyilvánosnak ítélte az adatokat, a Hajdú-Bihar Megyei Rendőr-főkapitányság és a Debreceni Városi Rendőrkapitányság hatvan napon belül köteles volt kiadni azokat.

A rendőrség akkori tájékoztatása szerint Hajdú-Bihar megyében 2008-ban 33 ezer kirendeléses ügy volt, ebből 23 ezer a debreceni kapitányság területén. A rendőrség az ügyszám nagyságára és az állomány leterheltségére hivatkozva kérte a kereset elutasítását.
