A Fidesz már megint bosszút áll a vereségéért///Fidesz is once again avenging his defeat

Megpróbálják megtörni a bírókat, akik a kormánynak nem tetsző ítéleteket mernek hozni.



Az történt, hogy kifulladt a Fidesz háborúja Botka László ellen. Nemcsak elveszítették az önkormányzati választást, és Botka megőrizte a polgármesteri posztot, valamint a közgyűlési többséget, ráadásul közben a Szeviép-perben a Fidesz udvari beszállítóit felmentették.

Másodfokon a bírói tanács úgy ítélte meg, az ügyészség nem tudta bizonyítani, hogy a cég szándékosan nem fizette ki az alvállalkozóit, így el kell fogadni az állításukat, hogy nem tudták kifizetni őket. Ártatlanok, haza is mehettek.

A Fidesz és a NER azonban nem fogadta el a vereséget, hanem elengedte láncaikról a kutyáit: a kormánypropaganda az elmúlt héten egymással versengve próbálta besározni a felmentő ítéletet hozó bírákat.

Azt állították róluk, hogy összeférhetetlenek, mert

Azonban az összeférhetetlenség se jogilag, se fogalmilag nem áll meg. A szegedi önkormányzat ugyanis semmilyen módon nem volt érintett az ügyben. Meg sem vádoltak, sőt, meg sem gyanúsítottak egyetlen önkormányzati vezetőt vagy tisztviselőt sem.

Az eljárás, majd a per kizárólag gazdasági szereplők ellen folyt, akikkel a bírónők semmilyen viszonyban nem voltak.

Pusztán az róható a terhükre, hogy egy városban (tudniillik Szegeden) éltek a vádlottakkal. Ami amúgy a dolguk, hiszen éppen ezért ítélkezhettek egyáltalán az ügyben.

Az nem érv az önkormányzat érintettsége mellett, hogy a Szeviép dolgozott Szeged városának megrendelésére is. Mert dolgozott más önkormányzatoknak, például – az akkor még fideszes vezetésű – Hódmezővásárhelynek, valamint a magyar államnak is. Ilyen alapon bíróság Magyarországon nem is tárgyalhatta volna az ügyet, mert minden bíró kap pénzt az államtól (lásd még fizetés).

A kormánysajtó hadjárata azonban két dologra mutat rá.

  • Egyfelől ezzel közvetve elismerik, hogy a hadjárat valóban a szegedi polgármester ellen folyt. Őt akarták leváltani, besározni az – elvileg – független hatóságok útján. Ezért ment az eljárás hat éven keresztül, ezért tapsoltak el több mint 3 milliárd forintot a kártalanításra.
    Mert a sok ezer közül melyik másik, 2008 után bedőlő cég ügyfeleit, alvállalkozóit és hitelezőit kártalanították még az adófizetők pénzéből?
  • Másfelől pedig bosszút állnak azon, akik miatt nem a terv szerint történtek a dolgok. A függetlenségük maradékait még mindig őrizni próbáló bíróságokon.

A Fidesz régóta érvel azzal, hogy nincs Magyarországon semmi baj a független igazságszolgáltatással, hiszen születnek a kormánynak, a kormánypártok és a pártállamnak nem megfelelő ítéletek is. Viszont mindent megtesznek azért, hogy ezután ne születhessenek ilyenek.

Utasítani nem tudják a bírókat, ezért próbálják megvásárolni őket (előléptetéssel, fizetésemeléssel, plusz juttatásokkal). Akit pedig nem sikerül, azt megfélemlíteni.

Névvel, arccal a lakájmédiában szerepeltetve vonják kétségbe az elfogulatlanságát annak a bírónak, aki a szakmai ítélőképességére, a jogi érzékére és a józan eszére merészel hallgatni a kormány kimondott vagy érzékeltetett elvárásai helyett.

Ki mer majd ezután a Fidesznek nem tetsző ítéletet hozni, ha tudja, hogy azzal nemcsak a szakmai előmenetelének árt, hanem emiatt a kormánypropaganda hamis vádakkal, nyilvánosan próbálja majd lejáratni?

Ami most történik, az a Szeviép-per ürügyén a bírói függetlenség maradékának elpusztítására tett kísérlet. A NER nem tudja elfogadni a vereséget, és azt, hogy még nem tudott mindent az uralma alá hajtani.

They are trying to crack down on judges who dare to rule against the government.

It happened that Fidesz’s war against László Botka had died out. Not only did they lose the municipal election, and Botka retained the mayor’s office and the majority of the general assembly, and in the Seveviep trial dismissed Fidesz’s court suppliers.

In the second instance, the Judiciary considered that the prosecution could not prove that the company had deliberately failed to pay its subcontractors, so their claim that they could not be paid should be accepted. Innocent, they could go home.

However, Fidesz and the NER did not accept the defeat but released their dogs from their chains: the government propaganda has been rivaling each other last week in seeking to acquit the acquittal judges.
They were said to be incompatible because

one of her husband’s joint ventures worked for the city of Szeged,
the other bought an apartment (!) from the municipality.
However, the conflict of interest does not stop either legally or conceptually. The Szeged municipality was not involved in the case in any way. They have not accused or even suspected any local government leader or official.

The proceedings, and then the litigation, were exclusively against economic operators with whom the judges had no relationship.
The only thing that can be attributed to them is that they lived in a city (in Szeged, for example) with the defendants. Which is their business anyway, which is why they were able to judge the case at all.

There is no reason for the municipality to be involved in the fact that Szeviép also worked for the city of Szeged. Because he worked for other local governments, such as Hódmezővásárhely, which was still led by Fidesz, and the Hungarian state. On this basis, a court in Hungary would not have been able to hear the case because all judges receive money from the state (see also pay).

But the government press campaign points to two things.

On the one hand, they indirectly acknowledge that the campaign was indeed against the mayor of Szeged. They wanted to replace him, to lock him in, in principle, through independent authorities. That is why the process went on for six years, and more than $ 3 billion was applauded for compensation.
Because which of the thousands of other companies that went bankrupt after 2008 have their customers, subcontractors and creditors still been compensated with taxpayers’ money?
On the other hand, they take revenge on those who did not go according to plan. Remains of their independence are still being tried in the courts.
Fidesz has long argued that there is nothing wrong with independent judiciary in Hungary, as judgments that are inappropriate for the government, government parties and the party state are made. But they do their best to prevent them from happening afterwards.

They cannot order the judges, so they try to buy them (promotion, salary increases, plus allowances). Whoever fails is intimidated.

Name and face appearing in the media disclaim the impartiality of a judge who dares to listen to his or her professional judgment, legal sense and common sense rather than the government’s explicit or perceived expectations.

Who then dares to make a judgment that Fidesz does not like, if he knows that it will not only harm his career, but that the government propaganda will try to denounce it publicly with false accusations?

What is happening now is an attempt to destroy the remainder of judicial independence under the pretext of the Seveviep trial. The NER cannot accept the defeat and the fact that it has not yet been able to control everything.
