A demokrácia, a jogállamiság, az egyenlőség és az alapvető jogok képezik az Európai Unió alapját, ezért is olyan fontos a védelmezésük minden szereplő részéről a kormányzattól a civil társadalomig – jelentette ki Didier Reynders, az Európai Bizottság igazságügyi biztosa Brüsszelben kedden. Didier Reynders a Budapest és Brüsszel önkormányzata által szervezett, Városok a jogállamiságért címmel tartott konferencián hangoztatta: amennyiben a tagállamok és a közösség jogi alapját jelentő jogállamiság megszűnik, az Európai Unió szűnik meg.

Kijelentette: a jogállamiság és közös értékek mentén működő igazságszolgáltatás szavatolása a tagállamok közötti bizalom alapja. A jogállamiság nem képezi alku tárgyát, a jogállamiság nem lehet politikai kompromisszum áldozata – mondta.

Emlékeztetett: az Európai Bizottságnak eszközök állnak rendelkezésére a jogállamiság védelmére. Egyik ilyen eszköz az évente közreadott jogállamisági jelentés, melyben a testület ajánlásokat fogalmaz meg a tagállamok ösztönzésére. A jelentés eszköz az általános problémák orvoslására, a jogállamiság helyzete romlásának megállítására – mondta.

A jelentés a párbeszéd alapját képezi a jogállamiság helyzetéről az egyes országokkal arról, hogyan lehet javítani a helyzetet az önkormányzatok és a civil társadalom részvételével – tette hozzá. Idei jelentését az uniós bizottság július folyamán tervezi közreadni – közölte.

– fogalmazott. Szavai szerint biztosítani kell, hogy a jogállamiságot mindenütt tiszteletben tartsák, hiánya esetén az uniós bizottság eljárásokat indíthat az értinett tagállam ellen. A testület minden rendelkezésére álló eszközt felhasznál a jogállamiság védelmében. Ilyen egyebek mellett az unió pénzügyi érdekeinek védelmére létrehozott feltételességi mechanizmus, amely Magyarország esetében a kohéziós programokat érintő kifizetések felfüggesztéséhez vezetett – emlékeztetett.

Democracy, the rule of law, equality and fundamental rights form the basis of the European Union, which is why it is so important to protect them from all actors, from the government to civil society, said Didier Reynders, the European Commission’s justice commissioner in Brussels on Tuesday. Didier Reynders stated at the conference entitled “Cities for the rule of law” organized by the municipalities of Budapest and Brussels: if the rule of law, which is the legal basis of the member states and the community, ceases, the European Union will cease to exist.

He stated: guaranteeing the rule of law and justice operating along common values is the basis of trust between member states. The rule of law is not subject to negotiation, the rule of law cannot be a victim of political compromise, he said.

He reminded: the European Commission has tools at its disposal to protect the rule of law. One such tool is the annual report on the rule of law, in which the board formulates recommendations to encourage member states. The report is a tool for remedying general problems and stopping the deterioration of the rule of law, he said.

The report forms the basis of the dialogue on the state of the rule of law with individual countries on how to improve the situation with the participation of local governments and civil society, he added. The EU committee plans to publish this year’s report in July, he said.

According to his words, it must be ensured that the rule of law is respected everywhere, in the absence of which, the EU committee can initiate proceedings against the concerned member state. The board uses all means at its disposal to protect the rule of law. Among other things, the conditionality mechanism created to protect the financial interests of the union, which in the case of Hungary led to the suspension of payments related to cohesion programs, he reminded.
